An Arizona man convicted of killing a road-rage victim will be resentenced after an appeals court ruled that an AI-generated video of the victim was improperly shown in court.
Gabriel Horcasitas was sentenced to 10 years in prison for fatally shooting 37-year-old Christopher Pelkey during a 2021 confrontation at a red light.
Pelkey’s family created the AI video using the family archive. At the original sentencing, Judge Todd Lang appeared to approve of the video, stating, “I heard the forgiveness.”
The Arizona Court of Appeals later ruled that the video went beyond documenting the victim’s life, instead portraying thoughts created from his sister’s imagination.
The court stated that the video “crossed that line” and ordered Horcasitas to be resentenced.
