Armenia says Azerbaijan distorts factual evidence, requests World Court to pursue ethnic cleansing case against Baku


The public hearings at the International Court of Justice on the preliminary objections raised by Azerbaijan in the case concerning Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Armenia v. Azerbaijan) concluded today.

During the hearings, which opened on Monday, 15 April 2024, the delegation of Azerbaijan was led by Elnur Mammadov, Deputy Minister for Foreign Affairs of the Republic of Azerbaijan, as Agent.

The delegation of Armenia was led by Yeghishe Kirakosyan, Representative of the Republic of Armenia on International Legal Matters, as Agent.

The Republic of Azerbaijan requested that the Court issues a Judgment:

1. Dismissing Armenia’s Application in its entirety on the ground that none of Armenia’s claims is properly before the Court because Armenia has failed to comply with the negotiation precondition required by Article 22 of CERD

2. In addition, or in the alternative, declaring that the Court lacks jurisdiction ratione materiae with respect to Armenia’s claims concerning alleged violations by Azerbaijan of its obligations under:

i. Articles 2 (1), 4 (a) and 5 (b) of the CERD by engaging in the discriminatory murder, torture and inhumane treatment of members of Armenia’s armed forces during the active hostilities phase of armed conflict;

ii. Articles 2 (1), 4 (a) and 5 (b) of the CERD by engaging in discriminatory murder, torture and inhumane treatment of Armenian civilians during the active hostilities phase of armed conflict, except with respect to any allegations, which Armenia has particularized with reference to specific evidence purportedly indicating misconduct ‘capable’ of falling within CERD;

iii. Articles 2 and 5 (a) of the CERD by engaging in practices of discriminatory arbitrary detention of ethnic Armenians; and

iv. Articles 2 and 5 (a) of the CERD by engaging in practices of discriminatory enforced disappearance of ethnic Armenians.”

On the basis of its written and oral submissions, the Republic of Armenia requests that the Court:

  1. Reject the first preliminary objection raised by Azerbaijan
  2. Reject the second preliminary objection raised by Azerbaijan; or in the alternative, decide that Azerbaijan’s second preliminary objection does not possess an exclusively preliminary character.”

“This week Azerbaijan disregarded the legal standards clearly established by the Court’s jurisprudence and distorted Armenia’s factual evidence. But Azerbaijan’s tactics has failed. It’s stance is not conducive to good administration of justice,” Armenia’s representative Yeghishe Kirakosyan said in his closing remarks.

He said “Armenia genuinely attempted to negotiate its claims under the CERD, but to no avail.”

“Azerbaijan’s racist violence, arbitrary detentions and enforced disappearances perpetrated against ethnic Armenians are plainly capable of falling within the CERD,” Kirakosan said.

The Court will now begin its deliberation. The Court’s decision on the preliminary objections will be delivered at a public sitting, the date of which will be announced in due course.

On 16 September 2021, Armenia instituted proceedings against Azerbaijan concerning violations of the International Convention on the Elimination of All Forms of Racial Discrimination.

Ruben Vardanyan launches hunger strike, demands release of Armenian political prisoners held in Baku


The family of illegally detained philanthropist, Ruben Vardanyan, announced today that he entered into a hunger strike to demand the immediate and unconditional release of himself and the other Armenian prisoners illegally held in Baku.

The hunger strike began on April 5, 2024, following repeated requests by Vardanyan and counsel to provide a fair and transparent trial in a timely manner in line with international legal standards. Suspiciously his hunger strike began, his family’s regular phone calls with him have been cut off, in clear violation of all international norms. The original trial slated for January was extended without cause to May.

Last September, armed forces of the government of Azerbaijan invaded Nagorno-Karabakh, triggering the exodus of the 120,000 inhabitants of the region. During the plight of the refugess, Vardanyan and 7 other former officials were arrested and now face spurious politically motivated charges. They are all political prisoners.

“I am deeply concerned about the health and well-being of my father,” said David Vardanyan, one of Mr. Vardanyan’s sons. “For nearly 200 days, my family has not seen my father. We have had absolutely no contact with him since he launched his hunger strike on April 5th.”

Vardanyan’s hunger strike tragically coincides with the 109th anniversary of the Armenian genocide which will occur on April 24th demonstrating how Armenians continue to be targets of ethnic cleansing and are still targeted for persecution around the world.

Ruben Vardanyan is a loving husband and a father of four. He is also an influential Armenian business leader, social entrepreneur, and philanthropist. Together with his partners from around the world, he has driven more than $1.5 billion toward advancing economic development, addressing humanitarian challenges, and supporting global education initiatives.

A former State Minister of the Nagorno-Karabakh Republic from November 2022-February 2023, Mr. Vardanyan has been charged with false accusations, held in conditions against international law, and faces a trial that will not be up to international standards, especially regarding access of international observers to the proceedings. In addition, Mr. Vardanyan’s case has been separated from the other seven political prisoners, raising questions about whether he in particular is being politically targeted.

“The illegal detention of Ruben and the other former leaders of Artsakh is an egregious abuse of human rights and the international justice system and must be ended,” said Paul Polman, Selection Committee member of the Aurora Humanitarian Initiative co-founded by Ruben Vardanyan. “The irony of this entire situation is that Azerbaijan has been selected to host COP 29 in a blatant attempt to “greenwash” their international reputation. COP has a major focus on the interconnectivity of climate change and human rights at a time when they are abusing both in plain sight”

Mr. Vardanyan’s family demands that:

1. All illegally detained ethnic Armenian prisoners, including Ruben Vardanyan should be released immediately and unconditionally.

2. Should the illegal trials proceed, they must happen before the prisoners’ detention orders expire in May, must meet global legal standards, and international observers and media must be allowed to attend.

3. The Azeri government must allow immediate access of the International Red Cross to assess the wellbeing of Ruben and the other prisoners. The family’s access to telephone calls with Mr. Vardanyan must be restored.

4. Any peace agreement between Armenia and Azerbaijan must include the release of all ethnic Armenian political prisoners.

5. COP 29 should not proceed in Azerbaijan without these steps occurring.

Heated Exchange as Interior Minister Questioned in Parliament


On April 19, Minister of Internal Affairs Vakhtang Gomelauri is in the Parliament in interpellation. The interpellation was to focus on the Ministry’s work against domestic violence and femicide, as well as drugs, but has been overshadowed by the topic of recent protests against the Foreign Agents Law and the alleged beating and detention by police of an opposition MP who is legally entitled to immunity.

Salome Samadashvili, a member of the opposition Lelo for Georgia party, addressed the Minister during his speech in Parliament, pressing him over the detentions and reported beatings during the protests, including of Irakli Kupradze, the Lelo for Georgia party’s Secretary General. Following warnings, MP Samadashvili was forcibly expelled from the plenary hall by the order of Speaker Papuashvili.

The session continued against the backdrop of heated exchanges, switching of microphones for the opposition deputies and sharp criticism by the opposition of the actions of the MIAs during the protest rallies against the “Foreign Agents” Law.

Rallies against “Russian Law”

Speaking of the recent protests against the “Foreign Agents Law,” the Minister claimed that “the public saw how the peaceful rally turned into the violent actions since the day one. While the protest was taking place in a completely peaceful situation, some of the participants became aggressive towards the law enforcement officers, threw various objects, including stones, bottles, poured paint, verbally and physically insulted the police officers, and did not obey their legal demands.”

The Minister claimed that five police officers were injured during the protests, with two of them hospitalized because of the “heavy injuries.” According to him, in total 40 protesters were detained on administrative charges.

Minister Gomelauri alleged that “certain forces” used “all kinds of methods” to reach their “goal” of escalating the situation.

Beating of MP During Rally

In the beginning of today’s Parliamentary session, the opposition MP Tamar Kordzaia asked the Minister to comment on MP Elisashvili’s case. Minister Gomelauri limited his comment to saying that the incident is “unfortunate.” Later during the interpellation he returned to the topic, adding that “I am sorry. What happened is very bad. The investigation has been launched. I do not want to make assessments…Let’s wait.”

Interpellation Questions

During the interpellation, the Minister read the responses to the eight questions posed by seven opposition MPs, which had been previously submitted in written form. The questions focused on a range of issues including the Ministry’s response to delayed response to domestic violence and violence against women; inter-agency cooperation against the problem; the Ministry’s policy towards its employees who commit the violence against women and domestic violence; the activities of witness and victim coordinators; the activities of the Human Rights Protection and Investigation Quality Monitoring Department; and the Ministry’s measures and efforts to combat the drug crimes.
