Former President Donald Trump has appealed to the U.S. Supreme Court, asking it to reverse a lower court decision that removed him from the ballot in Colorado for the 2024 presidential election. Trump, who was impeached and convicted by Congress for inciting the deadly Capitol riot on January 6, 2021, is barred from holding federal office under the 14th Amendment of the Constitution.
However, Trump claims that the impeachment and conviction were unconstitutional and politically motivated, and that he still has the right to run for president again. He argues that the Colorado Secretary of State, Jena Griswold, a Democrat, violated his due process rights by removing his name from the ballot without a hearing or a vote by the state legislature.
The lawsuit, which was filed on Monday in the U.S. Supreme Court, seeks to overturn a ruling by the 10th Circuit Court of Appeals, which upheld Griswold’s decision in December 2023. The 10th Circuit said that Griswold acted within her authority and that Trump’s impeachment and conviction were valid and binding.
